Pinterest Article - PSA

FYI - since I know we have a lot of "pinners" on this board - this article was shared in my newsfeed.  It seems like the same situation as Napster (I'm probably dating myself since some of you may not even be familiar with Napster), but it's enough to get me to probably close my Pinterest account. 

Basically, if someone sues you for pinning things without their explicit permission, then you're paying for not just your lawyer (to defend you), but you're paying for Pinterest's lawyer, and then if there's a claim against you (*or* Pinterest) you pay the claim for both - just like when people got sued for copyright infringement with Napster.

  • This is why I always go back and give credit to the person who "made" the item when I pin it.

    However this part:

     Kirsten turned to federal copyright laws and found a section on fair use. Copyrighted work can only be used without permission when someone is criticizing it, commenting on it, reporting on it, teaching about it, or conducting research.

    But then she says:  Repinning doesn't fall under any of those categories.

    That doesn't make any sense to me.  There are 500 characters to make comments on the work, or to critique it, or teach about it, or any of the above.  It seems like a pretty easy loophole to take advantage of imo.

    I wish you could!  I consider that one of Pinterest's biggest downfalls (I have all sorts of people I do not know IRL, or even through places like TN, following me).  I know that would limit dissemination and that helps grow traffic, but I really wish I could go private!

    I wouldn't be too too scared yet - but just thought this was worth passing along.  I guess it depends on if artists decide to go after individuals...

    This is exactly what I was thinking.  I always include some kind of comment line on the things that I pin.

  • I feel like the whole this is ridiculous.  I closed my account after like 5 hours because I had a ton of people following me and I didn't really want everyone I knew knowing about everything I like, something about it bothers me.  So yes, I also wish it was private.

    But that aside, I think the majority of people are responsible and have the pin link back to the original blog etc.  If you start scaring people with legal stuff like this, I think the blogs are going to suffer the most and that's too bad.  Honestly, I think if you put something on the internet you should watermark it and/or just be aware that it's now out there.  Unless someone profits off of it, it seems ridiculous to sue.
